Terms & Conditions – Mahalo Moves 2023 Copyright 

1.          Definitions

1.1  General Terms and Conditions: The general terms and conditions used by Mahalo Moves, which have been published at the Mahalo Moves website, www.mahalomoves.com.

1.2  Mahalo Moves: has its official seat at Hermanus Coenradistraat 2-1, 1063 XR, Amsterdam, The Netherlands and is listed in the Trade Register under number 63533928.

1.3  Mahalo Moves Card: a 3- class, 5-class card or a 10-class card, as referred to in Clause 5.

1.4  Single Session: a single session at Mahalo Moves to be attended and paid by the Student, other than on the basis of a Mahalo Moves Card.

1.5  Participant: the person who attends or wishes to attend a Retreat, Masterclass or Workshop.

1.6  Price: the total price of a Masterclass, Workshop, or Retreat, including the Booking fee, teaching fees and where applicable accommodation fees.

1.7  Private Class/Session: a private class/session, for which the Student must make an appointment in advance.

1.8  Retreat: a yoga retreat organised by Mahalo Moves and partners, which can be followed on a stand-alone basis.

1.9  Teacher/Personal Trainer: the yoga or Pilates teacher, or personal trainer.

1.10 Student: a person who attends and/or wishes to attend private or group yoga classes, trainings, retreats or workshops at Mahalo Moves.

1.11 Website: the website of Mahalo Moves: www.mahalomoves.com.

1.12 Workshop: A yoga- or movement-related workshop given or to be given by Mahalo Moves.

2.     Scope of Application

2.1 The General Terms and Conditions apply to any Mahalo Movement Card, membership and, Single and Private Classes of and at Mahalo Moves as well as to all Retreats, Masterclasses, and Workshops.

2.2  By participating in a Masterclass, Retreat, Workshop, or yoga/Pilates class or personal training session of Mahalo Moves, the Student agrees to the applicability of these General Terms and Conditions.

2.3  Mahalo Moves may from time to time amend these General Terms and Conditions. The most recent version of the Terms and Conditions is always the version that is applicable and is always available at the Website. Mahalo Moves will announce any amendments to the General Terms and Conditions in advance by email.

 

3.     Mahalo Moves Membership – Monthly, Mahalo Moves Membership – Yearly, Mahalo Moves Cards, Online Membership, and Online Mahalo Moves Cards.

Mahalo Moves offers the following possibilities of attending movement sessions at Mahalo Moves:

3.1  The Monthly and Yearly Membership entitle the member to one session per week during the term of the Membership.

3.2  The minimum Membership term for the Mahalo Moves Membership – Monthly is three (3) months. After the third month, the Monthly Membership is tacitly converted into a continuing agreement for an indefinite period. The minimum Membership term for the Yearly Membership is twelve (12) consecutive calendar months. After the twelve months, a Student’s Membership will automatically end.

3.3  The Membership commences on the agreed starting date and once the first payment is made in cash, by IDEAL, SEPA, PayPal or Credit Card. The next monthly cycles will be paid by credit card or direct debit (SEPA), until termination.

3.4  After the minimum term of three (3) months, the Mahalo Moves Membership – Monthly may be terminated every month. Mahalo Moves Membership – Monthly must be cancelled prior to the individual renewal date in order to end membership charges. Cancellation of the Mahalo Moves Membership – Monthly must be done by sending an email to yessica@mahalomoves.com. Mahalo Moves will not reimburse the Student for the remainder of any paid subscription period, nor will reimbursements be made for membership cancellations prior to any renewal date.

3.5  Mahalo Moves Membership – Monthly may be put on hold for one (1), two (2) or three (3) months. This may be done by sending an email to yessica@mahalomoves.com up until 1 day prior to the start of the new month’s Membership. The Yearly Membership may also be put on hold for one (1), two (2) or three (3) months during the 12-month period. This month of suspension does not count for the 12-month period; i.e. if the membership is put on hold for one (1) month the end date of the contract will be extended with one (1) month.

3.6  A Student may use any Membership only in the event of payment in cash, by credit card or direct debit (SEPA).

3.7  The Membership fee will be debited from the Student’s bank account around 3-7 days after the starting day of the current Membership instalment. If this starts on the 1st of the Month (e.g. 1 March), the Membership Fee will be debited between the 3rd – 7th of this month (e.g. around 5th of March). In case Mahalo Moves is unable to collect the Membership Fee on the first collection moment, there will be 5 automatic retries with approximately 24hrs interval between each attempt. After 5 unsuccessful attempts, the student will be blocked from booking classes until the payment has been completed. If the Membership Fee is not paid within two weeks, 25 euros administration costs will be charged.

3.8  All Dutch Bank accounts and bank accounts from European SEPA countries are supported for the direct debit payment (monthly Membership only). 3.9  The Mahalo Moves Membership commences when Mahalo Moves has received the Membership Fee from the Student.

4. MAHALO MOVES SINGLE SESSION/TRIAL CLASS

4.1 The Mahalo Moves Single Session and the Mahalo Moves Trial Class are entitling the Student to one (1) yoga class.

4.2 The Mahalo Moves Single Session and the Mahalo Moves TRY Class are valid for one (1) month from the date of purchase. The single (1) class must therefore be attended within one (1) month of the date of purchase. After that period this right lapses.

4.3 The Mahalo Moves Trial Class can be used once per student and only as a first visit of the student.

 

5. MAHALO MOVES CARD 3-CLASSES / MAHALO MOVES CARD 5-CLASSES / MAHALO MOVES CARD 10-CLASSES

5.1 The Mahalo Moves Card entitles the Student to three (3), five (5) or ten (10) movement classes.

5.2 The Mahalo Moves Card – 3 classes are valid for two (2) month after the first visit. The 3 classes must therefore be attended within two (2) month from the first visit. After that period, this right lapses. In case there has been no first visit within 2 months the 3 class card automatically expires. The Mahalo Moves Card – 5 classes is valid for four (4) months after the first visit. The 5 classes must therefore be attended within four (4) months from the first visit. After that period, this right lapses. In case there has been no first visit within 4 months the 5 class card automatically expires. The Mahalo Moves Card – 10 classes are valid for six (6) months after the first visit. The 10 classes must therefore be attended within six (6) months after the first visit. After that period, this right lapses. In case there has been no first visit within 6 months the 10 class card automatically expires.

 

6. 1 MONTH MEMBERSHIP/YEARLY MEMBERSHIP

6.1 The 1 Month Membership entitles the Student to two classes/sessions per week for 30 days.

6.2 The 1 Month Membership is valid for 30 days from the date of purchase. The classes must therefore be attended within 30 days from the date of purchase. After that period, this right lapses.

 

7. MONTHLY ONLINE MEMBERSHIP/YEARLY ONLINE MEMBERSHIP

7.1 The “Online Membership” entitles the Student to 3 online classes per week during the term of the Membership.

7.2 Online Classes can be viewed up to a minimum of one (1) month after they have been broadcasted. Except for Zoom Classes, classes will not be recorded because of privacy reasons. The minimum Membership term for the Monthly Online Membership is one (1) month. After the minimum term of one (1) month, a Student’s Monthly Online Membership may be terminated every month. A Membership must be cancelled by sending an email to yessica@mahalomoves.com prior to the renewal date in order to end membership charges.

7.3 The Online Membership commences on the day the first payment is made in cash, by IDEAL, PayPal, or Credit Card.

7.4 All Dutch Bank accounts and bank accounts from European SEPA countries are supported for the direct debit payment (monthly Membership only). 8.     Payment and Price Changes

8.1  All classes/sessions organized by Mahalo Moves must be paid for before they are held. Mahalo Moves accepts cash payments, Credit Card (Visa, Master Card), Ideal and PayPal.

8.2  As a general rule, direct debits for memberships are made monthly around 3-7 days from the starting date of the membership. If the amount cannot be collected, a student will be blocked from booking classes until payment is completed. Mahalo Moves reserves the right to change the pricing of all Mahalo Moves products. Any changes are announced in advance by placing statements on the Website, and/or by email. The currently applicable rates are always mentioned on the website of Mahalo Moves.

8.3  On presentation of an official Student card, Mahalo Moves grants a 10% discount on all private classes at Mahalo Moves, except for the TRY Card.

8.4  Before joining a yoga class, workshop or training, the Student must check in at the Teacher. After the Mahalo Moves Employee or Teacher has verified the registration and payment for the relevant yoga class, the Student is allowed to enter the class, workshop or training.

8.5  Any discounts that a student is entitled to should be applied during the booking & payment process. The discount cannot be applied retrospectively. I.e. once the payment has been made any unapplied discounts will not be refunded.

 

9.     Reservations and cancellations for Classes/Sessions

9.1  All classes are available for online booking 14 days in advance.

9.2  A Student can only book classes and smaller workshops via WhatsApp, phone call, email or online via Simply Meet.

9.3  A confirmed booking is valid until 5 minutes before the class starts. If the Student has not checked in by then, the booking expires and the reserved spot will become available to another Student.

9.4  Students can cancel their booking until twenty-four (24) hours before the group class starts. The Student can only cancel through directly contacting the teacher by WhatsApp.

9.5  If the Student has a Mahalo Moves Card and does not show up to the group class or does not cancel it up until twenty-four (24) hours in advance, this class will be charged from the Student’s card.

9.6  Cancelling an appointment for a private class/ group session can be done without charge up to 24 hours before the start of the appointment. The Student/Business Client will be charged in full if the private appointment is canceled within 24 hours before the start of the appointment.

 

10.  Schedule

10.1 The current weekly schedule is mentioned on the Website. Mahalo Moves reserves the right to change the schedule at any time.  

10.2 Mahalo Moves reserves the right to cancel a class that has been scheduled or to change the yoga teacher mentioned in the schedule in the event of force majeure, including illness of the teacher. In the case of replacement of a teacher, there will be no refund of any Membership fee. 

10.3  Mahalo Moves reserves the right to close its doors on public holidays or on other days, or when imposed by the government, in case of force majeure, national safety or a pandemic.

 

11.  Early Termination of Membership in case of illness

11.1 In the event of prolonged illness or an injury, the Student may terminate the Membership early. A request for early termination must be submitted to Mahalo Moves in writing and Mahalo Moves reserves the right to evaluate and handle each case individually. This termination may be sent by email to yessica@mahalomoves.com 

 

12.  Prices and Payment

12.1  Mahalo Moves states all prices of the treatments on her website and in the studio. The reported prices include VAT. 

12.2  Payments can be made in advance using the online booking system by IDEAL, Credit Card or Gift Voucher, or in cash. 

 

13.  Personal data and privacy

13.1  The client provides Mahalo Moves prior to the first session of a number of personal data necessary for careful personal training. Mahalo Moves treats confidential data of the client according to the guidelines of the Data Protection Act. Mahalo Moves will not provide the data of the client, sell or rent to third parties.

 

14.  Liability

14.1 Mahalo Moves is not liable for damage caused by incorrect and / or incomplete information provided by the client on relevant medical conditions, medication use, work or leisure.

14.2 Attending yoga classes, Masterclasses, Workshops, Retreats and leaving belongings in changing rooms are at the Student’s own risk. Mahalo Moves accepts no liability for loss or damage of personal belongings of a Student attending yoga classes, workshops, trainings or retreats and leaving belongings in the changing rooms at Mahalo Moves. If during a retreat or workshop the student causes loss or damage to property of the venue where the student is staying, the student will be held liable. This loss or damage is in no way covered by Mahalo Moves. The student is considered to have the right insurance to cover this loss or damage.

14.3 Mahalo Moves is not in any way liable for personal injuries sustained during yoga classes, workshops, trainings or retreats. Participating is always at the own risk of the Student.

14.4 Mahalo Moves provides the following guidelines for reducing the risk of an injury:

14.4.1   Always consult a doctor before starting yoga classes if you are not sure that you are completely healthy or if you are pregnant.

14.4.2   If you have an injury or any other physical inconvenience, always inform your yoga teacher about this before starting the yoga class.

14.4.3   Listen to and follow the instructions of the relevant teacher/trainer.

14.4.4   Perform the exercises carefully and bear your physical limitations in mind.

14.4.5   Do not perform any exercises that are painful.

14.4.6   Ask questions if you do not understand an exercise.

14.4.7   Although we strive to only provide correct information on our website, we are not liable for any inaccuracy and no rights can be derived therefrom.

15.  Complaints

15.1  If the client has a complaint about the treatment, this should be notified within 24 hours by email to yessica@mahalomoves.com. Mahalo Moves will offer an appropriate solution.

16.  Law

Any agreement between Mahalo Moves and its clients is governed by Dutch law. These conditions are filed with the Chamber of Commerce in Amsterdam.

 

18.  Personal Data

18.1  Mahalo Moves collects personal data of the Students and Participants to update its membership records, to execute payment orders and for administration and information purposes. Mahalo Moves handles this collection of personal data with due care and complies with the provisions of the Dutch Data Protection Act.

18.2 Mahalo Moves uses the personal data referred to in Clause 9.1 to inform the Students and Participants about activities of Mahalo Moves and any changes in the schedule, for example. If the Student or Participant does not want to receive communications from Mahalo Moves, he or she may unsubscribe from the mailing in the bottom of a received newsletter or communicate this to Mahalo Moves by sending an email to yessica@mahalomoves.com. The Student or Participant is aware (s)he cannot use all online services and products of Mahalo Moves in that case. 

18.3 Mahalo Moves never gives any personal data of the Students or Participants to third parties without their prior written consent.

19.  Governing Law and Dispute Settlement

19.1 The General Terms and Conditions are exclusively governed by Dutch law.

19.2 Any disputes relating to the General Terms and Conditions, any Membership, a Mahalo Moves TRY Card, other Cards, or a Student’s attending group classes, Masterclasses Workshops, or Retreats organized by Mahalo Moves are settled exclusively by the competent court in Amsterdam or any higher court.

 

20.  Code of Conduct

20.1 Students shall adhere to Mahalo Moves’ code of conduct at all times:

20.1.1   Please make sure you are clean and fresh when you attend the yoga class. The use of unscented deodorant is highly appreciated.

20.1.2   Mahalo Moves advises not to eat later than two hours before the start of the yoga class and, in any case, not to do movement sessions on a full stomach.

20.1.3   Please do not wear shoes in yoga studios.

20.1.4   Due to extra safety measures regarding the Covid-19 virus, we ask you to bring your own yoga mat and props when possible, and to bring covers to cover our props during classes, courses and workshops. Props may be used only when covered with a clean pillow case, scarf or towel. Mahalo Moves makes yoga mats available for use during yoga classes and workshops only when the Student brought a yoga mat towel to cover the mat. After classes, a mat must always be cleaned thoroughly and put back by the Student who has used it.

20.1.5   To allow everybody to find perfect inner peace, Students are requested not to talk in the yoga studio before, during and after the yoga class and to talk quietly in the other rooms.

20.1.6   The physical and mental integrity of Students must always be respected. Racism, sexual behaviour or sexually suggestive behaviour is not tolerated by Mahalo Moves.

20.1.7   Mahalo Moves reserves the right to deny Students who do not observe the house rules, to deny access to the Mahalo Moves premises and to terminate the Membership of the relevant Student without a refund of any membership fee paid already.

 

ADDITIONAL GENERAL TERMS AND CONDITIONS FOR MASTERCLASSES, WORKSHOPS, AND RETREATS OF MAHALO MOVES.

 

1.     Applicability of Additional Terms and Conditions and Definitions

Masterclasses, Workshops, and Retreats are governed by these Additional Terms and Conditions in addition to the General Terms and Conditions. The General Terms and Conditions form an integral part of these Additional General Terms and Conditions. By participating in a Masterclass, Workshop, or Retreat, the relevant Participant accepts the applicability of the General Terms and Conditions and the Additional General Terms and Conditions.

1.1  Mahalo Moves reserves the right to replace the teachers of Masterclasses, Workshops, and Retreats in case of illness or injury of the original teacher without further consequences. Mahalo Moves will guarantee that the replacement of a teacher will not affect the contents and quality of the training. Replacement of a teacher will therefore not be accepted as a valid reason for cancellation.
 

2.     Participation in Workshops and Registration

2.1  A Participant may participate in a Masterclass or Workshop after he or she has registered for it with Mahalo Moves in advance and paid the price. Registration may be affected by signing up through the website or by sending an email to yessica@mahalomoves.com. A spot in the Masterclass or Workshop is guaranteed once Mahalo Moves has received payment of the price and a confirmation of the registration is received in a confirmation email.

2.2  For some Masterclasses or Workshops, an “Early Bird Rate” applies. This reduced rate applies until the date specified on the Website. After this date, the normal rate, which is also specified on the Website, applies without exception.

2.3  All participants are responsible for having the correct insurance (health, travel and/or liability) needed to participate in the workshop.

 

3.     Participation in Retreats.

3.1  A Participant may participate in a Retreat after he or she has registered for it with Mahalo Moves in advance and paid the Price (where applicable including accommodation) including the Booking Fee. Registration may be affected by signing up through the website or by sending an email to yessica@mahalomoves.com. A spot in the Retreat is guaranteed after Mahalo Moves has received payment of the price (where applicable including accommodation) including the Booking fee and the student has received a confirmation of the registration in a confirmation email.

3.2  For some Retreats, an “Early Bird Rate” applies. This reduced rate applies until the date specified on the Website. After this date, the normal rate, which is also specified on the Website, applies without exception.

 

4.     Payments and Prices

4.1  The Price for a Masterclass, Workshop, or Retreat can be found on the Mahalo Moves website.

4.2  Payments for a Masterclass, Workshop or Retreat must be made in full before the Masterclass, Workshop, or Retreat is held. Payments can be made by direct debit, IDEAL, PIN, Credit Card (Master or Visa Card), or with PayPal.

4.3  In the event of participation in a Retreat, the Booking Fee must be paid upon registration. During the booking process, there is an option to pay the full teaching fees at once or in instalments. From these teaching fees, in case of cancellation within 4 months from the training or retreat by the student, for whatever reason and irrespective of the chosen payment option, an amount of €150 (Retreat) will automatically be considered as non-refundable booking fee. The remaining balance (where applicable including accommodation) must be paid 60 days before the Retreat scheduled at the latest.

4.4  Booking Fees are non-refundable when:

4.4.1      The Student cancels on his/her own initiative.

4.4.2      The Student cancels due to postponement or changed start date/time of a Masterclass, Workshop or Retreat by Mahalo Moves, or a changed teacher.

4.4.3      The Student decides to cancel because of changes in the Masterclass, Workshop or Retreat due to force majeure.

4.4.4      The Masterclass, Workshop, or Retreat is cancelled or postponed by Mahalo Moves for reasons due to force majeure.

4.4.5      If Mahalo Moves cancels a Workshop or Retreat for reasons other than force majeure, the Booking Fees and other payments will be refunded in full.

4.4.6      The Price for a Retreat, the corresponding Booking Fee and where applicable the accommodation fees are mentione on the Mahalo Moves website.

4.4.7      To complete the application for a Retreat, a Booking Fee payment, or in some cases the full payment, must be made through the Mahalo Moves website via iDEAL, Credit Card or PayPal.

 

5.     Cancellation of Workshop Registration

5.1  Any participation in a scheduled Workshop may be cancelled through our website within the cancellation window, after that cancellations (without refund) can be done by sending an e-mail to: yessica@mahalomoves.com

5.2  Workshop registrations can be cancelled free of charge until one (1) month before the scheduled Workshop date.

5.3  If the Participant cancels his or her registration for any workshop outside the cancellation window mentioned in 5.2 the Fee is non-refundable.

5.4  In case of force majeure like a pandemic, natural disaster, terrorist attack, etc., Mahalo Moves withholds the right to postpone, to cancel or to make adjustments to Workshop without further liabilities.

6.     Cancellation of Participation in Retreat

6.1  Any participation in a scheduled Retreat, may be cancelled only in writing. This can be done by sending an email to yessica@mahalomoves.com

6.2  The Retreat Participant may cancel his or her registration free of charge until four (4) months before the scheduled Retreat.

6.3  If the Participant cancels his or her Retreat between four (4) months and two (2) months before the scheduled Retreat, the booking fee will not be refunded.

6.4  If the Retreat Participant cancels his or her registration within two (2) months before the start of the Retreat, the Price (including accommodation) will be charged to the participant as the case may be.

6.5  If it turns out at the location of the Retreat that the Retreat Participant cannot participate in the Retreat for whatever reason, the Price (including accommodation) already paid will not be refunded.

6.6  Mahalo Moves reserves the right to cancel the Retreat if there are insufficient participants. In this case, the registration fee already paid by the Participants is refunded as soon as possible.

6.7  In case of force majeure like a pandemic, natural disaster, terrorist attack, etc., Mahalo Moves withholds the right to make adjustments to-, to postpone or to cancel the Retreat without further liabilities.

 

7.     Masterclass and Workshop and Schedule

7.1  The current Masterclass and Workshop Schedule can always be found on the Website. Mahalo Moves reserves the right to change the schedule at any time. If applicable, any changes are announced in advance by Mahalo Moves, mentioning them on the Website or by email.

7.2  Mahalo Moves reserves the right to cancel a scheduled Masterclass or Workshop in the event of force majeure (including illness of the relevant teacher). In this case, the booking fee already paid is refunded.

 

8.     Health

8.1  The Retreats have an intensive schedule and curriculum that is physically, mentally, and emotionally demanding. By participating, the Participant declares that he/she is healthy on a medical and mental-health level and is ready to fully participate in the demands of the program of the or the Retreats as the case may be. Additionally, the Participant must be able to support the group learning process. The Participant may be requested to leave the Retreat, as the case may be, if it is determined by the Teachers that his/her participation would in any way compromise a safe and cohesive learning environment.

8.2  By participating in the Retreats, as the case may be, the Participant declares that he/she is aware that it is his/her own responsibility to take care of his/her own health and well-being during such training at all times.

8.3  In addition to the stipulations of article 8.1, Mahalo Moves reserves the right to require clinical evaluations or other information to competently evaluate the Participant’s medical and/or mental-health preparedness.

9.     Liability

9.1  Mahalo Moves shall not be liable for any injury, loss or damages in connection with, or resulting from, participation in the Retreats, as the case may be.

9.2  The Participant will never engage Mahalo Moves, the Teachers, or any of the supporting staff, in legal proceedings relating to possible damages in whatever form, that may be the result of participation in the Retreats, as the case may be.

9.3  Mahalo Moves only works with qualified yoga teachers and will always offer yoga classes of the highest quality. Nonetheless, there is always a risk of injury involved when taking a yoga class. By participating in the Retreats, as the case may be, the Participant accepts such risk of injury. Mahalo Moves offers the following guidelines to diminish the risk of injury:

9.3.1      Consult with a physician when you are not sure you are completely healthy, or if you are pregnant, before starting to take yoga classes.

9.3.2      If you have an injury, or other physical issue, inform the yoga teacher thereof before you start your yoga class.

9.3.3      Listen to and follow the instructions of the yoga teacher.

9.3.4      Be conservative when exercising yoga and listen to your physical limitations.

9.3.5      Don’t do any exercises that are painful.

9.3.6      Ask questions when you do not understand an exercise.

 

10.  Applicable law, dispute resolution

10.1    Dutch law applies exclusively to the General Terms and Conditions.

10.2    Any disputes in connection with the General Terms and Conditions, or the participation in a Masterclass, Workshop, or Retreat as the case may be, will be resolved exclusively by a certified mediator in Amsterdam (Netherlands).
